Welcome to Tabletop Commons. The terms “we,” “us” and “our” refer to Tabletop Commons, ABN 63 656 827 855.
We operate this website and online store, including its information, features, products and services, to provide customers with a tabletop gaming and shopping experience. Our online store is powered by Shopify.
These Terms of Service describe your rights and responsibilities when you access our website, create an account or purchase products from us.
By accessing or using our website, you agree to these Terms of Service. If you do not agree to them, you should not use our website or purchase through our online store.
These Terms should be read together with our:
Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under Australian Consumer Law.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or other protection that cannot lawfully be excluded, restricted or modified.
If any provision of these Terms or one of our policies is inconsistent with a non-excludable right under Australian Consumer Law, that right will prevail to the extent of the inconsistency.
1. Access and customer accounts
You must use our website only for lawful purposes.
When creating an account or placing an order, you agree to provide accurate, current and complete information, including your contact, billing and delivery information.
You are responsible for maintaining the confidentiality of your account credentials and for activity performed through your account. Contact us promptly if you believe your account has been accessed without authorisation.
You must not transfer, sell or license your customer account to another person.
A parent or guardian is responsible for supervising a minor’s use of our website and any purchase made with their permission.
2. Product information
We make reasonable efforts to ensure our product names, descriptions, specifications, images, prices and availability information are accurate.
Product colours and appearance may vary slightly because of photography, lighting, packaging revisions and device-display settings. Publishers and manufacturers may also make minor packaging changes without notice.
These minor variations do not affect your rights where a product is materially different from its description or does not meet a consumer guarantee under Australian Consumer Law.
We may update product information, impose reasonable purchase limits or discontinue products at any time. Changes will not remove rights that have already arisen in relation to an accepted order.
Product references, trademarks and images belonging to publishers or manufacturers are used to identify the products offered for sale. Unless expressly stated, Tabletop Commons does not claim to manufacture or own third-party branded products.
3. Orders and acceptance
Submitting an order is an offer to purchase the products in that order.
An automated order confirmation acknowledges that we have received your order. An order is accepted when we confirm acceptance, begin preparing it for fulfilment or dispatch it.
We may decline or cancel an order for a legitimate reason, including:
- A product being unavailable;
- An incorrect price or material product-information error;
- Payment failure;
- Suspected fraud or unauthorised payment;
- A delivery restriction;
- A breach of a reasonable purchase limit;
- A supplier cancelling or restricting the product;
- Suspected unauthorised commercial resale; or
- A transaction that would be unlawful or breach a supplier restriction.
If we cancel an order after receiving payment, we will refund the amount paid for the unfulfilled products and any associated delivery charges.
Please review your products, quantities and delivery details carefully before submitting an order. Cancellation rights differ depending on whether the order contains available products or preorders.
Returns, exchanges and refunds are governed by our Return and Refund Policy and Australian Consumer Law.
4. Preorders and embargoed products
Products available for preorder will be clearly identified on the relevant product page. We will display an expected release or dispatch date where reliable information is available.
Some preorder products are subject to publisher or supplier embargoes. We cannot dispatch an embargoed product before its authorised release date, even if we receive stock earlier.
Release and embargo dates are determined by publishers or suppliers and may change for reasons outside our reasonable control. We will notify affected customers if we become aware of a material delay.
A preorder may be cancelled for a full refund at any time before dispatch. The refund will be issued to the original payment method.
Once a preorder has been dispatched, it becomes subject to our standard Return and Refund Policy. Sealed trading card products and individual trading cards are not eligible for change-of-mind returns after dispatch.
Nothing in this section limits your rights where a preorder product is faulty, damaged, incorrectly supplied or materially different from its description.
5. Orders containing preorder and available products
If an order contains both preorder and currently available products, we may hold the entire order until every product is available.
Customers who want available products dispatched separately should place separate orders or contact us before fulfilment. Additional shipping charges may apply to an agreed split delivery.
If you cancel only the preorder portion before dispatch, we will confirm the delivery arrangements and any applicable delivery charge for the remaining products before proceeding.
6. Prices, GST and payment
All prices displayed on our website are in Australian dollars and include GST where applicable.
Product prices do not include shipping unless expressly stated. Applicable shipping charges will be disclosed at checkout before you submit the order.
The amount charged will be the amount displayed at checkout and recorded in your order confirmation, subject to the correction of genuine errors under these Terms.
Promotions may have separate conditions, eligibility requirements and expiry dates. If promotion-specific terms conflict with these Terms, the promotion-specific terms will apply to that promotion, subject to Australian Consumer Law.
You agree to provide accurate payment information and confirm that you are authorised to use the selected payment method.
7. Pricing and information errors
Occasionally, product descriptions, prices, promotions, shipping charges, transit estimates or availability information may contain a genuine error or omission.
We may correct such information when an error is identified.
If a material error affects an order you have submitted, we will contact you as soon as reasonably possible. You may choose an available alternative, proceed on the corrected terms or receive a refund for the affected product.
We will not substitute a materially different product or impose an increased charge without your agreement.
Nothing in this section limits your rights under Australian Consumer Law.
8. Shipping and delivery
We dispatch orders throughout Australia using tracked Australia Post services.
Our usual dispatch days, shipping charges, free-shipping conditions, estimated delivery timeframes and procedures for delayed, lost, damaged and returned parcels are set out in our Shipping and Delivery Policy.
Delivery dates are estimates rather than guarantees. Delivery may be affected by carrier delays, public holidays, severe weather, regional delivery conditions and other circumstances outside our reasonable control.
If an order is delayed, lost, damaged or returned, we will provide reasonable assistance and any remedy required under Australian Consumer Law.
Customers are responsible for providing a complete and accurate delivery address. If an error is reported before dispatch, we will try to amend the address. Once an order has been dispatched, an address change or redirection may not be possible.
9. Local pickup
Local pickup is available from Tabletop Commons at 170 Cowper Street, Warrawong NSW 2502.
Pickup orders are ordinarily prepared within 24 hours during our business days. We are typically closed on Mondays and Tuesdays, so orders placed on Sunday will ordinarily be available on the next business day.
You must wait until we confirm that your order is ready before travelling to collect it. We may request your order confirmation or identification when an order is collected.

10. Returns, exchanges and refunds
Returns, exchanges and refunds are handled under our Return and Refund Policy and Australian Consumer Law.
Eligible non-TCG products may be returned within 14 days for an exchange or store credit, subject to the conditions in our Return and Refund Policy.
Sealed trading card game products and individual trading cards are not eligible for change-of-mind returns due to the risk of opening, resealing, substitution, tampering, handling damage and changes in market value.
These change-of-mind exclusions do not affect your rights where a product is faulty, damaged, incorrectly supplied, materially misdescribed or otherwise fails to meet a consumer guarantee.
A preorder may be cancelled for a full refund at any time before dispatch.
11. Intellectual property
The content and design of our website, including Tabletop Commons branding, original text, graphics, photographs and other materials, are owned by or licensed to Tabletop Commons and are protected by Australian and applicable international intellectual property laws.
You may access the website for personal and lawful use. You must not reproduce, distribute, republish, commercially exploit or create derivative works from our original website content without our permission, except where permitted by law.
Tabletop Commons’ name and logo may not be used in a way that falsely suggests sponsorship, approval or association.
Shopify’s name and branding belong to Shopify. Product names, logos, images and trademarks associated with third-party products belong to their respective owners.
Nothing on our website grants ownership of any third-party intellectual property.
12. Third-party services and links
Our website may contain links to third-party websites or use services provided by third parties, including Shopify, payment providers, Australia Post and social-media platforms.
Third-party websites and services are governed by their own terms and privacy practices. We are not responsible for third-party content or services merely because we provide a link to them.
This section does not exclude responsibility for our own conduct or any liability that cannot lawfully be excluded.
Questions or complaints about a third party’s independent products or services should ordinarily be directed to that third party. Questions about a purchase made directly from Tabletop Commons should be directed to us.
13. Relationship with Shopify
Our online store is powered by Shopify, which provides the ecommerce platform used to operate the website.
Products purchased through our store are sold by Tabletop Commons, not Shopify. Tabletop Commons is responsible for customer orders, fulfilment, returns and applicable consumer-law obligations.
Shopify may process information as described in its own privacy policy and our Privacy Policy.
Nothing in this section limits any right or remedy that cannot lawfully be excluded.
14. Privacy
Personal information collected through our website is handled in accordance with our Privacy Policy.
Because Shopify hosts our online store, information submitted through the website may be processed by Shopify and relevant service providers to operate the store, process transactions, prevent fraud and provide requested services.
Some service providers may process information outside Australia. Please review our Privacy Policy for further information about how personal information is collected, used, disclosed and protected.
15. Feedback and reviews
If you submit a review, suggestion, photograph or other feedback, you confirm that:
- You have the right to submit it;
- It is accurate to the best of your knowledge;
- It does not infringe another person’s rights;
- It is not unlawful, defamatory, abusive or misleading; and
- You have disclosed any incentive or compensation received in connection with it.
You grant Tabletop Commons a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that feedback for operating and promoting our business.
We may moderate or remove feedback that is unlawful, misleading, abusive, irrelevant, infringing or otherwise inappropriate. We will not alter a review in a way that misrepresents the reviewer’s opinion.
16. Prohibited uses
You must not use our website:
- For an unlawful or fraudulent purpose;
- To infringe another person’s intellectual property or privacy rights;
- To transmit malicious code;
- To impersonate another person or business;
- To submit false or misleading information;
- To interfere with the website’s security or operation;
- To collect personal information without authority;
- To send spam or unauthorised promotions;
- To bypass reasonable purchase restrictions; or
- To access another customer’s account without permission.
We may restrict or suspend access where reasonably necessary to protect customers, our business or the security of the website.
17. Suspension and termination
We may suspend or terminate access to a customer account where we reasonably believe it is necessary because of fraud, unlawful conduct, a material breach of these Terms, security risks or misuse of the website.
Where reasonably practicable, we will provide notice and an opportunity to address the issue.
Termination of website access does not remove rights or obligations relating to an existing order, refund, payment or consumer guarantee.
Sections that are intended by their nature to continue after termination—including intellectual property, privacy, liability, dispute and governing-law provisions—will continue to apply.
18. Website availability
We make reasonable efforts to keep our website and product information available and accurate.
We do not guarantee that the website will always be uninterrupted, secure or free from technical errors. We may temporarily restrict access for maintenance, security, platform updates or circumstances outside our reasonable control.
General information on the website is provided for informational purposes and should not be treated as professional advice.
Nothing in this section excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded.
19. Liability
Nothing in these Terms excludes, restricts or modifies liability for fraud, wilful misconduct, breach of a non-excludable consumer guarantee or any other liability that cannot lawfully be excluded, restricted or modified.
To the maximum extent permitted by law, Tabletop Commons is not responsible for loss caused solely by:
- A customer’s misuse of a product;
- Information or instructions supplied incorrectly by the customer;
- Unauthorised access resulting from the customer’s failure to protect their credentials; or
- Circumstances outside our reasonable control.
Where liability may lawfully be limited, it is limited only to the extent permitted by law.
20. Customer responsibility for unlawful conduct
You are responsible for losses reasonably incurred by Tabletop Commons as a direct result of your fraud, deliberate unlawful conduct, material breach of these Terms or deliberate infringement of another person’s rights.
This responsibility does not apply to the extent that the loss was caused or contributed to by Tabletop Commons, Shopify or another third party.
Nothing in this section limits your rights under Australian Consumer Law or makes you responsible for loss that was not reasonably foreseeable.
21. Severability
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be limited or severed only to the extent necessary.
The remaining provisions will continue to apply.
22. Waiver and entire agreement
Our failure to enforce a provision of these Terms immediately does not waive our right to enforce it later.
These Terms and the policies incorporated into them constitute the agreement between you and Tabletop Commons concerning use of the website and purchases from our online store.
Nothing in this section excludes a representation or right that cannot lawfully be excluded.
23. Assignment
You may not assign your rights or obligations under these Terms without our written consent, which will not be unreasonably withheld.
We may assign our rights and obligations as part of a genuine sale, transfer or restructuring of our business, provided the assignment does not reduce your rights under these Terms or Australian Consumer Law.
24. Governing law
These Terms are governed by the laws of New South Wales, Australia.
You and Tabletop Commons submit to the courts of New South Wales and any courts entitled to hear appeals from them.
Nothing in this section limits any right a consumer may have to bring a claim in another jurisdiction under applicable law.
25. Changes to these Terms
We may update these Terms to reflect changes to our business, website, policies or legal obligations.
The current version will be published on this page with its effective date. Where required by law, we will provide reasonable notice of material changes.
Changes will not retrospectively remove rights that have already arisen under an accepted order.
Continued use of the website after an updated version takes effect constitutes acceptance of the updated Terms for future use and purchases.
